Midwestern Governors Request Waiver Addressing RVP Requirements

Illinois, Iowa, Nebraska, Minnesota, Missouri, South Dakota, and Wisconsin April 16, 2025, to the Environmental Protection Agency (EPA) requesting an emergency supply waiver allowing the sale of gasoline blended with up to ten percent ethanol (E10) that exceeds the states’ applicable Reid Vapor Pressure (RVP) standard by 1-PSI. Should EPA grant the request, it would enable the same blendstocks to be utilized for E10 blending throughout the entire Midwestern market.

The Midwestern states who sent the request had previously opted out of the federal RVP regime in order to require a lower RVP fuel specification that accommodates year-round sales of gasoline blended with up to fifteen percent ethanol (E15). By opting out of the federal regime, those states seemingly intended to require 7.0 CBOB to enable E15 blending without running afoul of federal RVP restrictions.

Federal law currently restricts summertime E15 sales in many parts of the country. Specifically, Congress has provided a 1-PSI RVP waiver for E10 blends, but not for E15 blends. Â鶹ɫ²¥ has worked with the refining and ethanol industries to pursue a legislative fix for the federal restriction on E15, but Congress has yet to enact a legislative waiver into law.

Â鶹ɫ²¥ believes it is more likely than not that EPA will approve the Midwestern states’ request, but an approval is not assured. Â鶹ɫ²¥ also continues to anticipate that EPA is also likely to grant a nationwide emergency supply waiver in the near future that will permit E15 to be sold this summer in all parts of the country.
